How We Are Now

Terms and conditions

  • The exhibition is organised by the Board of Trustees of the Tate Gallery ("Tate").
  • By entering your photograph to the "How We Are Now" Flickr group, you declare to Tate and The Observer that the photograph was taken by you and is your own original work which will not infringe the copyright or any other rights of a third party.
  • Entrants must ensure that any third party copyrighted material contained in a photograph has already been cleared with the copyright holder.
  • All photographs submitted on the "How We Are Now" Flickr group may be displayed on Tate’s website, Tate Online, in Tate Britain as part of the How We Are: Photographing Britain; and on The Observer’s website and photographs may be used in online and offline material to promote the How We Are: Photographing Britain campaign and all entrants give Tate and The Observer a non-exclusive, worldwide, royalty free, irrevocable licence in perpetuity to use their photographs for such purpose.
  • All images must be a minimum of 500kb in size.
  • Photographs must not contain obscene or defamatory content or material.
  • In order for your photograph to be short-listed, it must be tagged with one of the exhibition's themes ("portrait", "landscape", "still life" or "documentary").
  • In the event that your photograph entered on the "How We Are Now" Flickr Group is short-listed by Tate as part of the final 40, you give Tate and The Observer a non-exclusive, worldwide, royalty free, irrevocable licence in perpetuity to use your photograph for the following purposes:
    • Your photograph may be displayed on Tate’s website, Tate Online, in Tate Britain as part of the How We Are: Photographing Britain; and on The Observer’s website.
    • Your photograph may be archived in perpetuity on Tate Online as part of the exhibition website.
    • You give Tate permission to download the high-resolution version of your photograph for the purposes of archiving the final selection of images.
  • Neither Tate nor The Observer shall be obliged to display photographs and shall not be liable for any entrant’s loss of publicity or enhancement of reputation.
  • Tate reserves the right to cancel the exhibition if deemed necessary at any stage.
  • Because of the volume of users expected to participate in the project, we are unable to reply to Flickr Mail messages. If you wish to contact Tate, please do so through our contact page.
  • In the event that your photograph is chosen to be displayed in Tate’s galleries and/or Tate’s website, it will be displayed along with your Flickr screen name and the title of the image.
  • In the event that your photograph is selected to be included in the final 40, we will contact you through Flickr Mail and you will be given the opportunity to choose to have your real name included in place of your screen name. If you do not respond to this email, Tate will be obliged to use your Flickr screen name.
  • Any personal information of entrants will only be used and, where necessary, disclosed to third parties, for the purposes of running the competition and otherwise in accordance with the Tate Online Privacy Policy.
  • By entering your photograph to the "How We Are Now" Flickr group you are deemed to have accepted the above terms and conditions.
