Returns Policy

TEL wants you to be totally satisfied with your purchase. If for any reason you are not entirely happy with your order TEL will refund the value of the goods supplied. TEL will repay you the value of the goods (excluding delivery costs) within 30 days from receipt of the returned goods without any further charge to you except the direct cost of returning the goods.

Please contact us by phone on 020 7887 8869 or email us at shop.online@tate.org.uk to obtain authorisation to return. You will be sent a letter of authorisation. Please appropriately package the items with the letter of authorisation and the original invoice and send it to us. For the return of high value goods, we recommend that you use a recorded delivery service, as we cannot be responsible for non-delivery of returned items.

Pricing and Currency

After ordering you will be contacted to confirm the cost of shipping your item(s).

The total cost of your order reflects the price of the items ordered plus a shipping charge for handling, packing and postage by the method you select.

All products are priced in pounds sterling (£), and include UK Value Added Tax where applicable.

Who are we?

Tate Enterprises Limited (TEL) is a trading company of Tate. All our profits go to support the work of the Gallery. Tate Enterprises Limited is a company registered in England and Wales under number 3173975 whose registered office is at Millbank, London SW1P 4RG. VAT Reg. No: 674 9453 88. The following terms and conditions listed below will apply between you and TEL for the sale and purchase of the items contained in your basket. The terms do not affect your statutory rights.

Validity

By ordering a product you accept these terms and conditions. The terms and conditions are subject to change at any time, and it is your responsibility to check these terms and conditions regularly before ordering products in case there are any changes.

Availability of Goods and prices

Availability information for titles is listed on each individual product. All items are usually despatched within 3 working days after an order has been placed. We aim to deliver within 3-5 working days for UK orders, within 7 to 14 days for European destinations and within 12 to 24 days for the rest of the world. If TEL has insufficient stock to deliver the goods you have ordered TEL will inform you by e-mail at the address given in your order form and any sum, which may have been credited from your credit card, will be re-credited to you within 30 days of the date of your order. Prices of some goods may differ from those in the physical shops at Tate Britain, Tate Modern, Tate Liverpool and Tate St Ives.

Your undertakings and warranties

You warrant that the information given on your order form is complete and accurate.

Acknowledgement of Order

When you have completed your order you will be sent an e-mail confirming your order. It will state what the products are, the cost (including VAT and P&P) and delivery and invoice details. If your order has been unsuccessful you will be made aware of the reason why and possible explanations.

Our Contract

A legally binding contract between you and us will be formed when we send you an email confirming that we have despatched the product(s) to you. This email shall represent our legal acceptance of the offer you made to purchase the product(s) when you completed your order. If we confirm to you that some but not other products that you have ordered have been despatched, those product(s) that have not been despatched will not form part of our contract with you. In the event of any change e.g. in price or expected delivery date between completion of your order and contract formation, we shall inform you and you shall at that point have the right to either (i) accept such change (in which case your email reply will represent a new offer which we will accept upon notification of despatch) or (ii) reject such change (in which case your email reply will represent a withdrawal of your order, or the relevant part of your order as the case may be).

Data Protection

TEL will never make your personal details available to other companies for marketing purposes. We will keep a record of your address details with the intention of sending your order. See Tate Online Website Privicy Policy for more information.

Payment

All credit and charge card holders are subject to validation checks and authorisation by the card issuer. If the issuer of your payment card refuses to authorise payment to us, your order will not be accepted and TEL will not be liable for any delay or non-delivery.

Returns

Your statutory rights as a consumer are not affected if, for any reason, you wish to return a product bought from Tate Online Shop.

Damaged goods or incorrect deliveries

Our warranty contained in 'Goods & Services' above is subject to the following conditions: (i) the goods must be stored in appropriate conditions; if you do not store them in appropriate conditions we cannot be held responsible for faults or problems that arise as a result; (ii) any claim by you in respect of any shortages and/or defects in the goods must be notified to us by you within seven days of the delivery date, stating the nature of the shortage/defect and quoting the invoice no.; failure to so notify us will deem you to have accepted the goods. In some cases TEL may require you to return the defective goods to TEL at its cost. Where you make a valid claim in respect of any shortages or defects and we are liable for the claim, we can at our option make up the shortages or replace the goods free of charge, or refund the price of the goods in question to you. In addition for defective goods we will refund you reasonable costs incurred for postage of the goods, but we shall have no further liability to you. If you do not notify TEL accordingly, TEL shall have no liability for any defects and you shall be bound to pay for the goods.

Force Majeure

TEL shall have no liability to you for any failure to deliver goods you have ordered or any delay in doing so or for any damage or defect to goods delivered that is caused by any event or circumstance beyond its reasonable control.

Limitation of Liability

Although we take every care to ensure accuracy, we make no warranties as to the accuracy of the information we place on our web pages. The extent of our liability for any breach of these terms and conditions shall be limited to the value of the goods ordered by you in the relevant transaction, however nothing in these terms and conditions shall exclude or limit TEL's liability for death or personal injury as a result of TEL's negligence.

Invalidity of Terms and Conditions

If for any reason part of these terms and conditions is unenforceable; the validity of the remaining terms and conditions shall not be affected.

Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with English Law and agree to submit to the exclusive jurisdiction of the English courts.
